Welcome to Black-V! These Terms of Service ("Terms") govern your use of our website black-v.com (the "Site") and the purchase of products through our online store. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to them, please do not use the Site.

Our products are intended for private, non-commercial use only. Commercial resale, distribution, or use of our products for business purposes without our written consent is prohibited.

2. Eligibility and Capacity to Contract

To use our Services and place orders, you must:

Be at least 16 years old with explicit consent from your parent or legal guardian for each purchase

Our Services are not intended for individuals under the age of 16. We do not knowingly enter into contracts with minors below this age.

By using the Site and placing orders, you confirm that you meet these requirements and have the legal capacity to enter into binding contracts under German law.

3. Formation of Contract

A binding purchase contract is formed when:

You submit an order through our checkout process
We send you an order confirmation email acknowledging your order
Payment is successfully processed

Our product listings constitute an invitation to treat, not binding offers. We reserve the right to refuse or cancel orders before contract formation.

4. Products, Prices, and Availability

All products, prices, and specifications are subject to change without prior notice
Prices include German VAT (Mehrwertsteuer) where applicable
We make reasonable efforts to display product colors and images accurately, but cannot guarantee exact representation on all devices
We reserve the right to discontinue products at any time
Some items may be fulfilled via dropshipping partners and shipped directly from external suppliers
If a product becomes unavailable after your order, we will notify you promptly and offer alternatives or a full refund

5. Payment Terms

Payment is due immediately upon order placement
We accept major credit cards, PayPal, and other payment methods as displayed at checkout
All payments are processed securely through certified third-party payment processors
We do not store your complete payment information on our servers
Prices are in EUR unless otherwise stated
In case of payment failure, your order may be cancelled automatically

6. Shipping and Delivery

Shipping costs and estimated delivery times are displayed during checkout
Delivery times are estimates and may be affected by customs processing, carrier delays, or force majeure events
Risk of loss transfers to you upon delivery to the carrier
We are not liable for delays, loss, or damage during transit once packages are in the carrier's possession
For international shipments, you are responsible for any customs duties, taxes, or fees

7. Right of Withdrawal (EU Consumer Rights)

This section applies to consumers in the European Union:

You have the right to withdraw from your purchase contract within 14 days without giving reasons. The withdrawal period expires 14 days after the day:

On which you (or a third party designated by you, other than the carrier) acquire physical possession of the goods
For multiple items ordered together: after you receive the last item
For goods consisting of multiple lots: after you receive the last lot or piece

To exercise your right of withdrawal:

To initiate a withdrawal, please fill out our Help & Contact form and select the category "Return".
Provide a clear statement of your decision to withdraw from the purchase contract
You may use our withdrawal form (available in our Return Policy) but this is not mandatory
Send notice before the withdrawal period expires
Important: Please do not return goods without contacting us first. Unregistered returns may be rejected or delayed in processing

Effects of withdrawal:

We will reimburse all payments received from you, including original delivery costs
Reimbursement will be made within 14 days using the same payment method you used
You must return the goods within 14 days of notifying us of withdrawal
You bear the direct costs of returning goods (typically €3-15 within Germany, varies for international returns)
You are liable for any diminished value of goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning

Exceptions to withdrawal right:

Sealed goods unsuitable for return for health/hygiene reasons if unsealed after delivery (e.g., underwear, swimwear)
Items that have been worn, washed, or damaged beyond what is necessary to examine them

8. Returns, Exchanges, and Warranty

In addition to your withdrawal rights above:

Defective Products (Legal Warranty)

Under German law, we provide a 24-month legal warranty for defects:

Report defects to us at Help & Contact form and select the category "Damaged or Incorrect Product" as soon as you discover them
We will repair, replace, reduce price, or refund as appropriate under German Civil Code (BGB)
This warranty covers manufacturing defects and non-conformity with product descriptions

Voluntary Returns (Beyond Legal Requirements)

Subject to our Return Policy, we may accept returns in additional circumstances at our discretion.

Process for All Returns

Contact us within the applicable time period via our Help & Contact form and select the category "Return"
Obtain return authorization and instructions
Package items securely in original packaging when possible
Include return authorization number with shipment
Return shipping costs: Customer bears costs for withdrawal returns; we bear costs for defective/incorrect items

9. Intellectual Property

All content on the Site—including text, graphics, logos, images, designs, and software—is the property of Black-V or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

Reproduce, distribute, modify, or create derivative works
Use content for commercial purposes without written permission
Remove copyright or proprietary notices
Reverse engineer or attempt to extract source code

10. Prohibited Uses

You agree not to use the Site:

For any unlawful purpose or in violation of applicable laws
To transmit harmful code, viruses, or malware
To interfere with Site security or functionality
To attempt unauthorized access to our systems or other users' data

To violate intellectual property rights

For Consumers: Nothing in these Terms limits our liability for:

Death or personal injury caused by our negligence
Fraudulent misrepresentation
Defective products under applicable product liability laws
Any other liability that cannot be excluded under German consumer protection laws

For other claims, our liability is limited to foreseeable damages typical for this type of contract.

13. Warranties and Disclaimers

You have statutory warranty rights under German law that cannot be excluded. These Terms do not affect those rights.

14. Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, government actions, or failures of suppliers or carriers.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect. Invalid provisions will be replaced with valid provisions that most closely achieve the intended economic purpose.

16. Governing Law and Jurisdiction

These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For Consumers: You may bring legal proceedings in the courts of your habitual residence or our registered office in Berlin, Germany.

17. Alternative Dispute Resolution (ADR)

The EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025. Information on consumer redress in the EU is available from the European Commission. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of § 36 VSBG. This does not affect your right to seek judicial remedies.

We may update these Terms at any time to reflect:

Changes in law or regulation
Changes to our Services
Other operational, legal, or regulatory reasons

Updated Terms will be posted on this page with a new "Last updated" date. For material changes affecting existing orders, we will provide reasonable notice. Your continued use after changes constitutes acceptance of the new Terms.
